1. General information

These Terms of Purchase govern the use of the Serigrafía Utopía online shop and the ordering of personalised products through this website. The owner's identification details are set out in our Legal Notice.

By placing an order, the customer declares that they are of legal age and fully accept these terms, as well as our Privacy Policy. We recommend reading them before each purchase, as they may be updated.

2. Products and personalisation

We sell garments and items that the customer can personalise with their own designs using different decoration techniques (screen printing, digital printing, embroidery, etc.).

  • The measurements of the item, the design and the print area shown in the configurator are indicative: we work with thousands of references and slight variations may occur. If something does not add up, the customer can tell us the actual measurements or add remarks to the order.
  • Before production we prepare a mock-up with the design in place for the customer to approve. Production does not start without that confirmation.
  • Colours displayed on screen may differ slightly from the final printed result.

3. Designs supplied by the customer

The customer is solely responsible for the files and designs they upload. By submitting them, they warrant that they hold the necessary intellectual and industrial property rights (trade marks, logos, images, texts) and authorise us to reproduce them solely to manufacture their order. We reserve the right to refuse unlawful or offensive content, or content that infringes third-party rights.

4. Ordering process

  1. The customer selects the product in the configurator, marks the print areas and technique, and uploads their design.
  2. They add the item to the basket. The colour and sizes, with the quantity of each, are selected at checkout.
  3. They enter their delivery and billing details and choose a payment method.
  4. After confirming the order, the customer receives an acknowledgement. The sale is completed when we confirm acceptance of the order.

5. Prices and taxes

Prices are shown in euros (€). Unless otherwise stated, configurator prices are shown excluding VAT; applicable taxes are itemised before completing the purchase. Shipping costs are calculated and shown at checkout before payment.

6. Payment methods

  • Bank transfer: the order is processed once the amount has been received.
  • Card: when paying by card the amount is held but not charged immediately. We first review and confirm the order; if there is any problem with the product, we contact the customer and no charge is made.
  • Quotation request: for special orders or large quantities, the customer can request a quote with no immediate payment.

7. Production and delivery times

The standard lead time is 7 to 9 working days. If the order has no decoration it may be delivered sooner. With the express option, delivery is within 24-48 h where there is no decoration, or according to the decoration (counted from design approval) where there is. If the customer needs the order for a specific date, they can write to us and we will arrange it, confirming whether it is possible.

8. Shipping

We ship to mainland Spain, the Balearic Islands and Portugal. Within Spain, standard shipping is free from €150 (excl. VAT); below that amount the applicable charges are shown at checkout. Shipments to Portugal have no free shipping and include a handling surcharge, also shown at checkout. Express shipping costs more. For the Canary Islands, Ceuta, Melilla and other countries, write to us and we will prepare a quote including shipping and, where applicable, customs formalities. Delivery times are estimates and may vary for reasons beyond our control (carrier, incidents, etc.).

9. Right of withdrawal

In accordance with article 103.c of Spanish Royal Legislative Decree 1/2007 (TRLGDCU), the right of withdrawal does not apply to goods made to the customer's specifications or clearly personalised. Therefore, items with printing or bespoke personalisation cannot be returned under the right of withdrawal.

For non-personalised products, the customer has 14 calendar days from receipt to withdraw, notifying us by email. The product must be returned unused and in its original condition; return costs are borne by the customer unless the law provides otherwise.

10. Returns, exchanges and warranty

If a product arrives defective, damaged or does not match the order due to our error, the customer must inform us as soon as possible (preferably within 48 h of receipt, providing photographs). Once verified, we will replace the item or issue a refund at no cost to the customer. The statutory warranty of conformity under applicable law applies.

11. Liability

We are not liable for errors in the delivery details or in the files supplied by the customer, nor for results arising from low-resolution designs. Our liability is limited in all cases to the value of the order.

13. Data protection

The processing of personal data provided during the purchase is governed by our Privacy Policy.

14. Applicable law

These terms are governed by Spanish law. Any dispute shall be settled by the courts and tribunals designated under the applicable consumer protection legislation.
